Notice for ‘MARANELLO WINES Società Cooperativa’ pursuant to Regulation (EU) 2016/679 (GDPR) and current national legislation

1. General Information 

Maranello Wines Società Cooperativa (hereinafter also referred to as “the Company” or “Maranello Wines”) hereby informs you (as you are about to proceed with registration in the specific section of the maranello.wine website and thus defining you hereinafter also as “user” or “interested party”) of the purposes and methods of processing the data (provided by you and/or resulting from processing by the Company) that it will possess. Online purchasing is allowed only for business customers, therefore it is understood that by user or interested party is meant the firm/company/entity itself or represented by the subject (who will be the registered subject and who will purchase) who will carry out the registration through the legal representative pro tempore/owner and your data will be processed by Maranello Wines only to identify you as the legal representative and for the purposes referred to in point 2 letters A, B, C, considering the consent to the data processing provided (through you) by the firm/company/entity you represent. Furthermore, consent for the purposes referred to in point 2 letter A of this information will also be considered provided by you by registering your name on the site as the legal representative of the firm/company/entity you represent. 2. Purposes 

Your data will be processed by Maranello Wines: 

A. to allow you to register with Maranello Wines and recognize you, once registered, as a user and manage the registration itself (without consent for such purposes you will not be able to register); the processing is based on the following legal basis: consent; 

B. should you proceed with a purchase, in order to fulfill obligations arising from the purchase contract and therefore also for administrative-accounting purposes and for order management. As for the data related to the credit card and bank account, please also refer to the payments section of the website; the processing is based on the following legal basis: execution of contractual obligations; 

C. to fulfill an obligation provided by law, a regulation, or community legislation, for legitimate interests such as asserting or defending a right of the Company. The processing is based on the following legal bases: fulfillment of legal obligations and pursuit of legitimate interests; 

D. to respond to a specific request of the interested party to receive, if provided, informative newsletters on products and promotions related to goods sold by Maranello Wines by marking the appropriate field during account registration or entering the email in the “Subscribe to the newsletter” area present in the footer of every page of the portal. Unsubscribing from the newsletter can be done at any time by the user following the instructions indicated at the bottom of each communication made for the purposes of this point.

3. Mandatory Data Provision
 A. The provision of data in the registration form marked as mandatory is necessary for the purposes referred to in point 2 letter B of this information, and therefore the refusal to provide them in whole or in part may result in the impossibility for the Company to execute the contract and thus to purchase the Company’s products. The indication of the product to be purchased and the payment method is necessary to be able to purchase the product itself (and therefore always for the purposes referred to in point 2 letter B of this information), and the failure to indicate them results in the impossibility of purchasing the product. For other data contained in the optional fields, please also see what is reported below. Where not otherwise specified in this information, the data in the optional fields can be provided optionally, and the failure to provide them will not have any consequence other than not being able to use such data (which may still be useful for the purposes in question). 
B. The provision of data (tax code or VAT number, personal and address data, billing and purchase data, other data that may be necessary to fulfill legal obligations, regulations, and community legislation or to assert or exercise a right of Maranello Wines) for the purposes indicated in point 2 letter C of this information, is necessary, and the failure to provide them results in the impossibility to register and/or to proceed with the purchase contract. 
C. The provision of data indicated as mandatory in the registration form, for the purpose of registration (point 2 letter A of this information), is optional, but the failure to provide them will result in the impossibility of carrying out the registration itself. As for other non-mandatory data and other possible data provided, the provision is optional, and the failure to provide them will not have any consequence other than not considering such data, which could in some cases be useful for better managing the order. 
D. The failure to provide the data required for the issuance of the invoice (such as the VAT number and the company name) will result in the impossibility of issuing the invoice with the indicated data, if requested. 
E. The provision of data related to alternative addresses to which to ship the goods is optional, but the failure to provide the data will result in the impossibility of shipping the material to the indicated address. It is reminded that for such particular activities, the user commits under their own responsibility to obtain the consent of the subject whose data is indicated, to ship the goods to their address or to indicate them as the recipient of the goods. Furthermore, the User for such activities commits to inform the subject whose data is communicated to Maranello Wines (subject to whom the goods are to be shipped or the recipient of the gift) that they will communicate the data to Maranello Wines so that Maranello Wines can process them (through the appointed and responsible parties indicated who must have knowledge of them for the performance of the tasks assigned by Maranello Wines) in order to ship the material to the indicated address and also informing them that Maranello Wines will give them specific information on the data processing, making them aware from the outset that Maranello Wines may communicate the data to carriers and shippers and that the provision of data is optional and the failure to provide them will result in the impossibility of shipping the goods to the indicated address and/or indicating the subject as the recipient of the gift. The User commits to obtaining the consent (where due) to the communication of data to Maranello Wines and to their processing (therefore also consenting to the registration in the Company’s databases) by Maranello Wines itself for the purposes specified above in this point. In this case, the user’s data will also be known by the recipient of the goods.
 
4. Categories of data recipients 
The Company will not communicate data to third parties for the purposes referred to in point 2 letter A of this information. The data may be communicated by the Company for the purposes referred to in point 2 letter B of this information (communicating only the data necessary for the pursuit of such purposes) both in Italy and abroad to: banks for due payments, carriers and shippers, post offices, distributors, companies (including foreign ones), lawyers and legal consultants, accounting auditing firms where not appointed as data processors. For the purposes referred to in point 2 letters B and C of this information, the data may be communicated in Italy and abroad (communicating only the data necessary for the pursuit of such purposes) by Maranello Wines to judicial authorities, tax police, public security, and public bodies if there is an obligation to such communication, as well as to law firms and legal consultants and post offices (which may see the address for sending any written communications). The Company will take care to communicate to third parties the purposes for which the data has been conferred and communicated to them. Then, for Maranello Wines, all the subjects delegated by the Company (administrative staff, shipping and enveloping staff even outside the Company, marketing staff and website management even outside the Company, IT technicians in charge of managing the information systems who may also perform system administrator functions, public relations staff, legal office staff, members of the Board of Directors and the board of statutory auditors, internal auditors, interns, freelancers and consultants-collaborators even outside the Company acting under the direct responsibility of the Company, such as IT technicians who may also perform system administrator functions, quality consultants, legal consultants, and auditors, collaborators of internal and external data processing managers) and the internal and external data processing managers (e.g., companies-professionals-firms that carry out activities instrumental to those of Maranello Wines such as marketing activities, shipping and enveloping or call center activities, accounting auditing and public relations management, IT outsourcing companies also residing in other states) may become aware of the data. The list of data processing managers is always available by contacting the Data Controller.
 
5. Data Retention 

Data will be retained for the period necessary to fulfill the purposes contained in this information. The data retention period is as follows:

  • For legal obligations, regulations, and community legislation, data may be stored for the periods imposed by these regulatory sources.
  • For contractual purposes until the termination of the relationship and even after termination for the period determined by the regulations.
  • For the purposes referred to in point 2 letter A of this information, data may be stored until consent is revoked or a request for deletion is made. In any case, all data can be stored for a period necessary to assert or defend a right of the company according to regulations.

7. Rights 

We inform you that the GDPR provides the possibility for the data subject to ask the Data Controller (at the above contacts) for access to personal data and the rectification or deletion of the same or the limitation of the processing concerning them or to oppose their treatment, in addition to the right to data portability, as well as other rights contained in the GDPR including the right to revoke consent, where provided: the revocation of consent does not affect the lawfulness of the processing based on the consent given before the revocation.

8. Complaints 

Data subjects who believe that the processing of personal data referring to them carried out through this service occurs in violation of the Regulation have the right to lodge a complaint with the Guarantor, as provided by art. 77 of the Regulation itself, or to take appropriate legal action (art. 79 of the Regulation). 9. Processing Methods 

We therefore inform you that such data will be processed by Maranello Wines manually, on paper, computer, or telematically (thus treating and storing the Company or data both on paper and computer support) and protected with protection systems designed to safeguard confidentiality. All the above data will be stored and processed in full respect of confidentiality in compliance with all current regulations (and therefore also in respect of the principles of fairness, legality, transparency, and protection of confidentiality and rights) and with logic strictly related to the purposes indicated in this information. Only the operations necessary to pursue the purposes indicated in this information will be carried out on the data. The data will be stored, as far as the Company is concerned, at the premises in Europe and at the data processors appointed by the Company (as well as at third parties to whom the data is communicated as specified in this information). The data will also be organized in databases – databases including computer databases. We remind you that only for technical assistance needs, data may be sent to companies operating outside the European community that are specifically appointed as responsible, committing to comply with all the prescriptions of European legislation, also signing the specific Contractual Clauses indicated by the Data Protection Authority; the data is only a copy of those contained in the European servers and the copy of the same is always available at the Company.
